TERMS AND CONDITIONS FOR EVENT HIRE
These Terms and Conditions ("Terms") set forth the terms and conditions for the hire of boats for event purposes ("Event") by [Cassini Adventures] ("Company") to the person or entity making a booking ("Customer").
Understanding your responsibilities and the Terms and Conditions for chartering Cassini Adventures legally rests 100% with you. If you do not understand or require clarification to any of the Terms and conditions, we are happy to discuss this with you.
A deposit to secure your date with Cassini Adventures signifies your agreement to all our Terms and Conditions.
- Booking and Payment (a) The Customer must provide a written request to the Company specifying the date, time, duration, and any additional services or amenities desired for the Event. (b) The Company will confirm the availability of the requested date and time and provide the Customer with a quote for the total cost of the Event, including any additional services or amenities. (c) If the Customer agrees to the quote, the Customer must provide a non-refundable deposit of 50% of the total cost to secure the booking. The remaining balance must be paid 14 days prior to the Event. (d) Payment can be made by Bank Transfer. If payment is not received by the due date, the Company reserves the right to cancel the booking.
- Cancellation and Refunds (a) If the Customer cancels the Event less than 14 days prior to the scheduled date, the Customer will forfeit the entire deposit. (b) If the Customer cancels the Event more than 45 days prior to the scheduled date, the Company may, at its sole discretion, refund a portion of the deposit, minus any costs incurred by the Company. (c) In the event that the Company cancels the Event due to unforeseen circumstances, such as adverse weather conditions or technical issues with the boat, the Customer will be entitled to a full refund of any payments made.
- Responsibilities of the Customer (a) The Customer is responsible for providing accurate and complete information to the Company at the time of booking, including the number of guests attending the Event and any special requirements or requests. (b) The Customer is responsible for the behaviour of all guests attending the Event at all times and must ensure that they comply with all applicable laws, regulations, and safety guidelines of both Cassini Adventures and the Australian Maritime Safety Authority (AMSA). (c) The Customer must not bring any illegal substances or dangerous items on board the boat. (d) The Customer must comply with all instructions given by the Company's staff or crew during the Event, including safety instructions and rules regarding the use of equipment or facilities on the boat.
- Insurance and Liability (a) The Company maintains appropriate insurance coverage for the boat, but the Customer is strongly recommended to obtain their own insurance to cover any loss, damage, or injury incurred during the Event, including but not limited to personal belongings, valuables, and vehicles. (b) The Customer agrees to indemnify and hold harmless the Company and its officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, and expenses arising out of or in connection with the Event, including but not limited to personal injury, property damage, or breach of these Terms, except to the extent caused by the Company's negligence or wilful misconduct.
- Force Majeure (a) The Company shall not be liable for any delay or failure to perform its obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, government actions, wars, terrorism, civil unrest, labour strikes or disputes, transportation disruptions, or other unforeseen circumstances. (b) In the event of a force majeure event, the Company may, at its sole discretion, reschedule the Event to an available date or cancel the booking and provide a refund of any payments made by the Customer, minus any costs incurred by the Company. Cassini Adventures reserves the right to cancel your charter or suspend any remaining time at any point should the charterer not comply with Terms and Conditions safety requirements or directions of crew. Refunds in these situations will not be applicable.
- Governing Law and Jurisdiction: These Terms shall be governed by the laws of AMSA. Any disputes arising out of or in connection with these Terms shall be resolved exclusively by the courts of NT and or Maritime Authority.
- Over intoxication. Cassini Adventures is a BYO only venue. It does not take any responsibility for Over Intoxicated guests however will have experienced crew to assist in situations that may occur. Cassini Adventuresprioritises the safety of all guests during the event and takes reasonable measures to ensure a safe environment on the boat. Patrons must follow the direction of the crew regarding over intoxication and if noncompliance occurs, we reserve the right to end the charter on the spot.
- Liabilities. The hiring of our boats is an activity that is undertaken at your own risk. While we take all care and supply all safety equipment, Cassini Adventures accepts no responsibility for lost items, personal injury, or death.
- Damage to Cassini Adventures Property and Equipment. As the charterer, you are responsible for all damage caused to a Cassini Adventures vessel. Should any party on the vessel cause damage in excess, in the case of a successful insurance claim by us to recover the cost, an excess of up to XYZ ADD HERE may still be payable by you. Where the damage is not recoverable by the insurer, legal proceedings to recover all damage and repair or replacement costs will be borne by the contract leaseholder (you). If the damage is caused by one of your guests, the onus is on you to recover the cost from them, not us. We hold the charterer (you) responsible for the damages regardless of which party guest is at fault.
- The hire cost covers a normal clean for the charter. If additional deep cleaning is required, such as vomit, excessive glitter or paint, large spills, stains or cigarette burns an additional fee will be charged to the charterer (you).
